1. Agreement to Terms

By accessing and using MySwapDeck ("Platform," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our Platform.

2. Platform Overview

2.1 Marketplace, Not Transaction Party

MySwapDeck is a peer-to-peer marketplace that connects gamers for game swaps. We are not a party to any swap transactions between users. We do not take possession of, sell, or guarantee any games. Users are solely responsible for the condition, authenticity, and legality of items they list and swap.

2.2 No Warranties

The Platform is provided "as-is" without warranties of any kind. We do not guarantee:

• That listed games match their descriptions
• That users will complete swaps
• That items will arrive in described condition
• That all transactions will be satisfactory

3. User Eligibility

• You must be 18 years old or have parental consent to use this Platform
• You must provide accurate information during signup
• You must not misrepresent your identity or impersonate others
• Your account must be approved by our admin team before you can swap

4. Prohibited Content & Activities

You agree NOT to:

• List counterfeit, stolen, or unauthorized games
• Misrepresent game condition or authenticity
• Engage in fraud, scamming, or deceptive practices
• Harass, threaten, or abuse other users
• Manipulate trust scores or manipulate the platform
• Use automated tools or bots to interact with the platform
• Attempt to bypass payment systems or access features without proper subscription
• Share another user's personal information without consent
• Post spam, malware, or harmful content
• Violate any applicable laws or regulations

5. Subscription & Swap Limits

5.1 Free Tier

• 1 free swap per calendar month
• Access to marketplace and profiles
• Messaging with swap partners

5.2 Premium Tier

• Unlimited swaps per month
• All Free tier features
• Premium badge on profile
• Priority game listings
• Ad-free experience

5.3 Swap Counter

Your monthly swap count resets on the 1st of each calendar month. Swaps initiated but not accepted still count toward your limit.

6. Trust Score & Reviews

6.1 How It Works

Your trust score reflects your reputation on MySwapDeck. It is calculated based on completed swaps, reviews received, and referrals. A higher score indicates a more trustworthy user.

6.2 Reviews

After completing a swap, you and your partner may leave reviews (1-5 stars with optional comments). Reviews must be honest and based on actual swap experiences. False or defamatory reviews may result in account suspension.

6.3 Reports & Disputes

If you believe another user has violated these terms, you may report them. We will investigate and take appropriate action, including account suspension or termination.

7. Payments & Refunds

7.1 Payment Processing

Premium subscriptions are processed through Paystack. All payments are in Nigerian Naira (₦). By subscribing, you authorize recurring charges for your selected plan duration.

7.2 Subscription Cancellation

You may cancel your subscription anytime. It remains active until the end of your billing period. No refunds are issued for partial month cancellations.

7.3 No Refunds for Game Swaps

MySwapDeck does not process refunds for unsatisfactory swaps. Disputes between users are resolved between the users directly or through local resolution (police report, etc.).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: MySwapDeck, its founders, employees, and partners shall not be liable for:

• Losses from user disputes or failed swaps
• Damage to games during transit or meetups
• Platform downtime or technical issues
• Indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid for your subscription in the past 12 months (if any).

9. Account Termination

9.1 Grounds for Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Receive multiple reports from other users
• Attempt to manipulate the platform or trust system

9.2 Your Rights Upon Termination

Upon account termination, you may request your data in accordance with our Privacy Policy. Remaining subscription credit will not be refunded.

10. Intellectual Property

All content on MySwapDeck (logos, design, code, text) is owned by MySwapDeck or licensed partners. You may not reproduce, distribute, or use this content without permission. Game titles and images are property of their respective publishers.

11. Safety & Meetup Guidelines

While MySwapDeck implements trust scoring and verification, we cannot guarantee user safety. You are responsible for your own safety during meetups. We recommend:

• Meeting in public places (malls, cafes, etc.)
• Meeting during daytime hours
• Bringing a trusted friend
• Inspecting items before completing the swap
• Trusting your instincts and avoiding suspicious users

12. User-Generated Content

By uploading photos, descriptions, or messages to MySwapDeck, you grant us a non-exclusive license to use this content to operate and improve the Platform. You remain the owner of your content.

13. Dispute Resolution

13.1 Between Users

Disputes between users are resolved directly between the parties. MySwapDeck may provide mediation advice but is not responsible for outcomes.

13.2 Against MySwapDeck

Any dispute between you and MySwapDeck shall be governed by the laws of Nigeria and resolved in Nigerian courts.

14. Changes to Terms

We may update these Terms of Service at any time. Changes take effect immediately upon posting. Continued use of the Platform constitutes acceptance of updated terms.
